What Are H-1B1 Visas?
Similar to the more commonly known H-1B category, the H-1B1 visa is for individuals in a “specialty occupation” that requires both of the following:
- Theoretical and practical application of a body of specialized knowledge
- Attainment of a bachelor’s degree or higher in the specific specialty (or equivalent) as a minimum for entry into the occupation
- Employers must file a Labor Condition Application (LCA) with the U.S. Department of Labor, which requires a prevailing wage determination
The validity period of the H-1B1 cannot exceed the validity period of the LCA. There are only a certain number of visas available each year under this category. For Chile, the numerical limit is 1,400. For Singapore, the limit is 5,400.
