Earlier this year, the Eight Circuit Court of Appeals made a ruling that detainees could be held without bond during their mandatory detention while waiting for their deportation. Despite this, many detainees have been released from ICE’s custody after successfully arguing that their arrests by ICE were unconstitutional.
